Terms of Service

These Terms of Service ("Terms") govern your use of the Caloy mobile application and any related services (the "Service"), provided by the Caloy developer ("Caloy", "we", "us", or "our"). By downloading, installing, or using Caloy, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Caloy. If you are between 13 and the age of majority in your country, you must have permission from a parent or guardian. Caloy is not intended for, and may not be used by, anyone under 13.

2. Your account

Caloy uses Sign in with Apple to create your account at the end of onboarding. Apple shares with us a stable opaque user identifier and, only if you choose to share them, your name and an email address (which may be Apple's privacy relay address). We do not see or store your Apple ID password. You are responsible for keeping your Apple ID and device secure. If you revoke Sign in with Apple for Caloy in your iOS settings, your in-app data may become inaccessible to you and will be deleted from our servers after a reasonable backup window.

3. Subscriptions and billing

Caloy offers a free trial followed by an auto-renewing subscription ("Caloy Premium") that unlocks unlimited AI photo scans, the AI meal planner, extended photo retention, and other premium features. The trial length is shown on the in-app paywall before you purchase.

• Payment: All purchases are processed by Apple through your Apple ID. Caloy does not see or store your payment details.
• Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
• Cancellation: Manage or cancel anytime in Settings → Apple ID → Subscriptions on your iPhone.
• Refunds: Refund requests are handled by Apple at reportaproblem.apple.com. Caloy cannot issue refunds directly.
• Price changes: If we change the subscription price, we will notify you in advance and you may cancel before the change takes effect.
• Trial conversion: Caloy Premium starts with a free trial. If you do not cancel at least 24 hours before the trial ends, your Apple ID will be charged for the first paid subscription period automatically, and the subscription will renew at the displayed price each period until you cancel.

4. Acceptable use

You agree not to:

• Use Caloy for any illegal, harmful, or fraudulent purpose;
• Attempt to bypass rate limits, authentication, or other security mechanisms in order to abuse our AI endpoints;
• Reverse engineer, decompile, or extract the source code of the app, except as permitted by applicable law;
• Resell, sublicense, or redistribute the Service or any part of it;
• Upload content that is illegal, infringing, or that contains malware.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

5. Health and dietary disclaimer

Caloy is not a medical device and does not provide medical, nutritional, or dietary advice. Calorie estimates, macro breakdowns, meal plans, and any guidance produced by Caloy's AI are estimates for general informational purposes only.

• Always consult a qualified physician or registered dietitian before changing your diet, especially if you have a medical condition, are pregnant or nursing, are under 18, or have a history of disordered eating.
• AI-generated calorie and macro values may be inaccurate. Use Caloy as a rough guide, not as a precise scientific instrument.
• Caloy does not diagnose, treat, cure, or prevent any disease.

You use Caloy at your own risk. Do not rely on Caloy for life-critical decisions.

6. User content

"User Content" means anything you submit to Caloy: meal photos, food entries, weight and water logs, and similar inputs. You retain ownership of your User Content. By submitting it, you grant Caloy a worldwide, non-exclusive, royalty-free license to use, host, and process the User Content solely to operate and improve the Service (for example, to send a meal photo to our AI for analysis and store the resulting log).

You are responsible for the User Content you submit and represent that you have the right to submit it.

6.1 Recipe catalog

Caloy's in-app recipe catalog (the "Catalog") contains over 2,000 recipes that were generated using large language and image AI models — specifically Anthropic's Claude (for recipe text and ingredient lists) and image-generation models accessed via fal.ai (for recipe imagery). To improve nutritional accuracy, the per-serving macro values for each recipe in the Catalog are recomputed against the U.S. Department of Agriculture's Food and Nutrient Database for Dietary Studies (FNDDS) — they are not AI-estimated values.

Recipes in the Catalog are provided as informational suggestions only. They have not been kitchen-tested by a registered dietitian or chef. When preparing any meal from the Catalog:

• Verify that the listed ingredients match your dietary restrictions and allergens. Caloy cannot detect cross-contamination, hidden ingredients in commercial products, or your individual sensitivities.
• Follow standard food-safety practices for cooking temperatures, refrigeration, and produce washing.
• Adjust seasoning, cooking times, and portion sizes to suit your preferences and equipment.

Caloy retains the rights to the Catalog as a curated compilation under applicable database and compilation copyright laws.

"As is" basis. The Catalog is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of nutritional accuracy, taste, fitness for any particular dietary goal or medical condition, or culinary suitability.

User responsibility and risk. You are solely responsible for evaluating the suitability of any recipe for your individual dietary needs, allergies, medical conditions, religious or cultural restrictions, and culinary skill level. You assume all risks associated with preparing and consuming meals selected from the Catalog. If you are unsure whether a recipe is appropriate for you, consult a qualified dietitian or physician before preparing it.

Liability. To the maximum extent permitted by applicable law, Caloy is not liable for any injury, illness, allergic reaction, food poisoning, or other harm resulting from the selection, preparation, or consumption of recipes from the Catalog.

7. AI outputs

Caloy uses third-party AI models (Google Gemini 2.5 Flash) to generate calorie estimates and meal-related responses. AI outputs:

• May be inaccurate, incomplete, or inconsistent;
• Should not be relied upon for medical, legal, financial, or safety-critical decisions;
• Are provided "as is" without any warranty of correctness.

8. Intellectual property

The Caloy app, name, logo, and all related materials are owned by us and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use Caloy for personal, non-commercial purposes in accordance with these Terms.

9. Third-party services

Caloy uses third-party services to operate (Apple, Google Firebase, Google Generative Language API, fal.ai, RevenueCat, AppsFlyer). Your use of those services through Caloy is subject to their own terms and privacy policies, summarized in our Privacy Policy.

Third-party data attribution. Caloy's food database includes information from Open Food Facts, made available under the Open Database License (ODbL), and from the U.S. Department of Agriculture's FoodData Central (public domain). Nutrition values returned by Caloy may originate from either source and are provided "as is" — Caloy does not guarantee the accuracy of third-party database entries.

10. Termination

You may stop using Caloy at any time by uninstalling the app, cancelling any active subscription via Apple, and revoking Sign in with Apple for Caloy. We may terminate or suspend your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.

11. Disclaimers

To the maximum extent permitted by law, Caloy is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.

12. Limitation of liability

To the maximum extent permitted by law, Caloy and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to us, if any, in the 12 months before the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Caloy and its developers from any claim, damage, liability, or cost arising from your violation of these Terms or your misuse of the Service.

14. Changes to these Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of Caloy after a change constitutes acceptance of the revised Terms.

14a. Entire agreement

These Terms, together with our Privacy Policy and any in-app disclosures presented at purchase, constitute the entire agreement between you and Caloy concerning the Service, and they supersede any prior agreements or understandings.

14b. Severability

If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14c. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Caloy.

14d. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of all or substantially all of our assets.

15. Governing law

These Terms are governed by the laws of the country and jurisdiction in which the Caloy developer is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the competent courts of that jurisdiction, except where applicable law gives you the right to bring claims locally.

16. Apple-specific terms

If you obtained Caloy through the Apple App Store, you acknowledge that:

• These Terms are between you and Caloy, not Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to furnish maintenance or support for Caloy.
• If Caloy fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no further warranty obligation regarding Caloy.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
